DISCLAIMER: Seller makes no warranties as to merchantability or fitness for a particular purpose; either expresses or implied, and disclaims any responsibility for the product when used not as intended or by inappropriate users.
PURCHASER'S RESPONSIBILITY: WAIVER AND ASSUMPTION OF RISK Purchaser must inspect all equipment before using it and take full responsibility for assuring that the equipment is in good working order and safe to use. You further understand that you are responsible for damage to equipment. Purchaser understands the nature of motor scooter riding and motorcycle related activities and acknowledges that Purchaser is qualified to operate said motor scooter, and is in proper physical condition to participate in such activity. Purchaser agrees to assume all risks when allowing others to operate Purchaser s scooter. If Purchaser is not familiar with the nature of motor scooter riding, Purchaser should seek professional training before operating a scooter. Purchaser knows, understands, and appreciates the inherent risks of riding a motorcycle: these risks may include, but are not limited to minor scrapes, strains, and bruises, as well as significant injuries such as broken bones, eye injury or loss, concussions, paralysis, and even death. By signing this document, Purchaser fully assume the inherent risks associated and assert that Purchaser is voluntarily participating in such activities. Purchaser understand that by signing below, Purchaser has read this release of liability, fully understand it, freely and voluntarily sign the same, and Purchaser is acting for herself, heirs, personal representatives and assigns. Seller will NOT be liable for any injuries to rider nor vehicle. Warranty is voided if product is used in competitive sport, modified, open, rented, and/or ridden by more than one person at a time or used for jumping, stunts or similar activity.
A written manual is included with your scooter, please read it completely to avoid injuring yourself and others. Review all the safety instructions carefully before operation. Remember to always operate your scooter with the proper safety gear and helmet.
OPERATION, REGISTRATION AND LICENSE: Purchaser is responsible for registering and operating the motor scooter in accordance with local and state laws and ordinances. Seller makes no representations that the motor scooter is legal for operation in your City and State. Purchaser must be 18 years of age or older. For your safety you should wear helmet. Driver license is required for scooters and motorcycles.
Screws, nuts and bolts should be checked before each ride.
THE VEHICLE IS SOLD WITH ALL FAULTS; “SOLD AS IS”. ALL SALES ARE FINAL. NO EXCHANGE.
WARRANTY: We guarantee our vehicles from manufacture mechanical defects only, claims must be made within 2 (two) days of you (the customer) receiving the order, and approved items must be received by Snack Attack Corp. within twenty (20) days of you (the customer) receiving the order, please see the RETURN POLICY for details.
You are responsible to inspect your vehicle’s nuts and bolts prior to every ride.
For your safety we recommend that you always wear a DOT approved helmet, proper shoes, eye wear / facing shield, gloves and protective clothing.
COVERAGE AND LIMITATIONS:
THIS LIMITED WARRANTY COVERS THE ENGINE ONLY: that proves defective by reason of improper workmanship or materials. This warranty is explicit to manufacturer's defects only.Items NOT covered by any warranty under any circumstance are FOR EXAMPLE but not only: tires, wheels, wheel bearings, horns, lights, body panels, fuses, forks, shocks, gaskets, light bulbs, seats, CV Boots, oil filter, air filter, fuel filter, filters, clutch wear parts, cables, drive belt, chain, spark plug, any part made from rubber, belts, brake linings and/or pads, batteries, sprockets, external springs, clips, nuts, bolts, fasteners, frame.
LABOR TO REPAIR OR REPLACE PARTS:the buyer must pay for labor for the removal and replacement of any needed component(s) or part(s). This warranty does not include labor, wearable parts or damaged parts from accidents, abuse, or shipping. Snack Attack Corp. does not pay nor reimburse any labor cost under any circumstances. This limited warranty only covers parts not labor.
BREAK-IN PERIOD: Avoid full throttle rides for the first 300 miles. Always allow your scooter or motorcycle to warm up to operating temp before riding off. Usually 1 minute of warm up is plenty. DO NOT ride full open for extended periods. Riding faster than manufacturer recommended speed can cause your vehicle to stall, overheat or worse. Our mechanics can determine if a bike has been abused.
Assembling:
Please read the Manual and follow the instructions in order to assemble your vehicle. All vehicles require some simple assembly. Each vehicle is unique and will have different assembly requirements. Common assemblies include: mounting wheels (nuts and bolts, tires already mounted on wheel), handlebar (nuts and bolts), electrical connection (simple plug in), battery hook up (nuts and screws) and mirrors (screws). Mechanical assemblies such as: motors or carburetors are not required. Our vehicle can be assembled within 30 minutes to 3 hours depending on the vehicle you purchase. You may want to have professional mechanic (any small engine repair shop, motorcycle shop, or local auto repair shop) or an authorized Dealer assemble your new motorized vehicle and do the prep work to assure your vehicle is in good working condition. You will need to provide proof of this when filing a warranty claim, so keep your receipts.For your safety and the safety of your family, any necessary assembly or maintenance should be performed by a certified technician in order for warranty to be valid. We are not responsible for damages due to inappropriate assembling. There may be unforeseen issues that require the expertise and knowledge of a trained professional. These issues include, but not limited to: electrical connections that have become disconnected in shipping, vacuum or fuel hose(s) dislodged in shipping and loose nuts and bolts in need of tightening. While these issues are normally very simple to correct, most being a simple re-connection, they can be a nuisance and very difficult to troubleshoot without the proper knowledge.
Our first concern is your safety and satisfaction. These vehicles will be driven at high speeds and by children in some cases. These concerns are better preserved by having your vehicle properly assembled and inspected prior to use.
Return Policy
Returns, Exchanges, & Refunds:
Every vehicle is carefully inspected before shipping.
Subject to the limitations stated in this agreement, Snack Attack Corp. agrees (at its sole discretion and election) to replace a covered component if the covered component fails as a result of a manufacture mechanical defect within the component stated warranty period from the date of purchase, while the component is being used under the conditions and in the manner specified by its original manufacturer.
All return/exchange must be approved by a Snack Attack Corp. Customer Service representative. A return/exchange authorization will be issued to those with approval, and this Return Authorization number must be written on the outside of the package. Returns/exchanges sent without prior authorization will be returned to the customer, and no exchange will be offered.
All return/exchange/refund claims must be made within 2 (two) days of you (the customer) receiving the order, and approved items must be received by Snack Attack Corp. within twenty (20) days of you (the customer) receiving the order, or return/refund will be refused, and no refund/exchange/return will be issued. All returned/exchanged/refund pending parts, apparel or accessories must be in their original UNOPENED packaging or no credit/exchange will be issued.
All returns/exchanges/refunds not due to a selling error of Snack Attack Corp. are subject to a nonrefundable 30% restocking fee. You agree to the terms of these fees at the moment you confirm your order.
Returned Parts
Defective warranty part(s) are required to be "returned to exchange" for new replacement part(s). New replacement part(s) under warranty will be shipped to buyer at no additional costs. Returning your defective part(s) will ensure we send you the correct part(s). Call our Customer Service to obtain a Return Authorization Number; all parts sent without it will be rejected. All packages are closely inspected before any return/exchange/refund or credit is issued.
REPAIRED COMPONENTS: If the components may be repaired under the terms of this agreement, they will be repaired; if not it will be replaced with component parts of like kind and quality.
S&H Charges and WHO pays:
IN WARRANTY: If your product is still under warranty you have to return any part for exchange, at your expense, to our Parts center after obtaining your Return Authorization number. We will pay return shipping to you unless it is determined your part was abused or damaged other than manufacturers defect.
OUT OF WARRANTY: Customer is to pay for parts, S&H both ways and all labor charges. In all cases you must send us the part that needs to be replaced.
GENERAL SHIPPING INFORMATION:
Please keep in mind that it is our goal to ship your order the same day it is placed if we receive your order before 11:00 am Eastern Standard Time. Most Orders are ready to be processed for shipping within 24 to 72 business hours (3 business days). It takes approximately in between 2 to 14 business days for delivery depending on the delivery location. We do not ship on Saturdays, Sundays, or Holidays. Any orders placed on Saturday or Sunday will be processed the next business day.
There may be an occasion when we are temporarily out of stock on a particular item. Items that are not available for immediate delivery will state they are "temporarily out of stock". Usually we are restocked in a matter of days but on occasion an item can take weeks to be restocked. You can always contact us to find the current status of a certain item you wish to purchase, just contact our Customer Service 954-455-4750.
Shipping Fees
Free Shipping! We do ship to Continental USA only.
Lift Gate Service: For easy unloading a lift gate service fee will be add in all residential deliveries.
Residential Service: Delivered to your home for an extra fee that will be added once your address is confirmed as a residential. No extra fee for business addresses.
Free Notification Service: Trucking Company will contact you to schedule your delivery appointment that is most convenient to you. The tracking number and the trucking company's information will be emailed to you once your order has been shipped out so you can track your shipment as it is in transit.
An additional shipping insurance may be added under your request to protect your investment against any lost or damaged shipments. We are not responsible for shipping damages or losses. In the event your product was lost or damaged during transit, you must contact the shipping company as soon as you notice the problem.
LOST or SHIPPING DAMAGES
We safely packs and crates all items to assure your items to arrive free of shipping damages. However in the event you find your product lost or damaged during shipping, please contact the shipping company. Please be sure to inspect your package when it arrives. Any damages must be noted on the delivery receipt to be eligible for damage claim reimbursement. We will not be liable for any damages nor losses due to transportation.
****Please save all original packaging material in case the shipping company exercises their rights for inspection, if it is possible take pictures to document the damage.
CANCELLATIONS
Cancellations must be made within 24 hours after the order is placed. Please contact a Customer Service Representative in order to cancel your order. You may cancel your order and obtain a full refund ONLY if the order has not been shipped and/or is not awaiting shipment. Once the item is shipped, the order cannot be canceled. If you choose to cancel your order you will be charged for a 30% restocking fee. Please allow 6 to 7 business days for your account to be successfully refunded in full. You will be notified via email with a confirmation once refund has been approved.
SHIPPING POLICY:
• All shipping related fees are prepaid in full.
• Snack Attack cannot guarantee delivery schedule.
• Snack Attack s is not responsible for shipping delays.
• Snack Attack is not responsible for damages occurred during shipping. You should file a Claim with the Shipping Company if damage occurs; please inspect your product upon arrival!
• Snack Attack is not responsible for any extra cost incurred by the customer after the vehicle or the part has been shipped.
• If shipping funds are not included when you order a part, this part will not be shipped.
• Snack Attack is not responsible for any cancellation incurred cost. All incurred cost due to cancellation must be paid in full and is not refundable. (Example: If product or part has left the warehouse and the order is canceled. The shipping company will charge freight whenever the product leaves our warehouse.)
• Refused packages will be charged with 30% restocking fee that will be charged automatically after receiving the package back
Shipping and Handling charges are neither refundable nor creditable.
While we aim for 100% customer satisfaction, please make sure you know exactly what you want before you order. If you are unsure that a particular part will work, please call us if you need additional information BEFORE confirming your order. Only manufacturer defects will be accepted as a cause of return/exchange please read the Terms and Conditions for details. You must take a picture of the defect and email it to us in order to obtain a Return Authorization.

THIS AGREEMENT AND LIMITED WARRANTY IS VOID IF ANY OF THE FOLLOWING IS TRUE:
• THE CUSTOMER DOES NOT USE A PROFESSIONAL MECHANIC (SMALL ENGINE REPAIR SHOP, MOTORCYCLE SHOP, OR AUTO REPAIR SHOP) OR AN AUTHORIZED DEALER TO ASSEMBLE AND PREP THE PRODUCT PRIOR TO OPERATION. Proof of this is required for warranty claims.
• THE DAMAGE TO THE COMPONENT IS CAUSED BY AN ACCIDENT.
• THE CUSTOMER FAILS TO FOLLOW THE MINIMUM MAINTENANCE AND BREAK-IN REQUIREMENTS SUGGESTED BY THE MANUFACTURER AND FAILS TO PROVIDE PROPER SERVICE DOCUMENTS.
• THE DAMAGE TO THE PRODUCT IS CAUSED DURING SHIPPING.
• PRODUCT IS USED IN A MANNER WHICH IT WAS NOT DESIGNED FOR.
• THE PRODUCT IS MODIFIED IN ANYWAY.
• THE PRODUCT IS USED IN RENTAL BUSINESS.

Improvements to products may result in unannounced small changes to specifications and external appearance. We strive to list and advertise all text and product information as accurate as possible. However, unforeseen typographical errors, picture errors and inaccurate information on this website may occur. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice, including order that have already been submitted. If such errors occur, we apologize for any inconvenience.
